EEA4 - when am I eligible for PR?

Hi all

Am about to submit, but thought I'd double check this as I fear I may not be able to apply.
  • Married, 19/03/2009 outside of the UK
  • Wife (EU national) arrives 28/03/2009 with a confirmed employment
  • I (non EU) arrive 18 June 2009 with a visa in my old passport
  • In Nov 2009, I apply for a residence permit which was granted Dec 16, 2009
Now I want to apply for my EEA4 on the basis that I have been here from 18 June 2009 to now (5 years and 1 month). Also, I can prove that my wife was exercising treaty rights continuously without a break for that period.

Can I do that, or can I only apply later in the year closer to the EEA2 expiry date (16 Dec 2014)

You can apply now. The date on the RC is irrelevant.
Check the FAQ before posting!
Citizenship (adults, children, passport)
EEA (EEA FP, RC, PR, Surinder Singh)
