Hi,

I am working in UK since 6 months. Now, I just realized that my Tier2 VISA expires in 2016 (for 3 years), while my Sponsorship is until 2015 (for 2 years). In the sponsorship, it is stated that the contract is 3 years long. Should VISA be precisely as long as the Sponsorship? Do you think this is a mistake and that it needs amendment?

I would definitely applied for amendment if it was shorter... but 3 years kind of makes sense because it fits with the contract...

First grant of tier 2 general is for three years as a minimum regardless of the stated COS start and finish dates.
If your sponsor ends your contract or it expires before the end date of your visa they tell UKVI and if there is more than 60 days left on your visa they curtail it.
No need to do anything about it.

Actually, pre Apr 14 it was 3 years + 1 month, or the period of engagement + 1 month, whichever the shorter. Post Apr 14 it is 5 years + 1 month, or the period of engagement + 14 days, whichever the shorter.

what is the work end date stated in your CoS and what is the expiry date of your visa?

Sorry, I checked carefully another time and my Visa expires in September 2016, while there was no info about my contract on the CoS. The CoS ends in Jennuary 2016. My contract ends Jennuary 2016.

As long as you are employed by the sponsor when the visa expires it will not make any difference to you when it comes to extending.
I would not get hung up about it, the standard grant was common place from the ECOs as it presumed correctly or not that 3years was the norm. 3years and one month to keep manci happy :-)

Hi, my employer is insisting that I apply for amendment... Do you know what could be the consequences of unrightfully requesting an amendment? For example, can I get flagged and VISA extension rejected later, if I request amendment when there is nothing to correct? Since I came after winning an administrative review, I would like to avoid annoying them further...

It doesn't make sense... I applied for a Tier 2 in Aug 2011 and the CoS was for 3 years. But the visa I got was for 2 years and 11 days (19 days short due to delay in processing). They didn't even give me a few days extra and the end date was as per CoS.

How-come they are able to give 3 years, if the CoS is for 2 years? As the regulations say, "Which ever period is shorter"

Manci, I applied in Aug 2011, and got 2 years and 11 days (19 days short of the dates as per CoS) because they processed it late... Shouldn't they have given me 14 days or 1 month extra?

CoS start date: 1 sept 2011
CoS end date: 1 sept 2014

Visa stamped 19 Sep 2011, End date: 1 Sept 2014.

Did they make a mistake? Or is it up to them all the time whatever they wish to grant?

I don't think you should worry. As long as you change employers (or extend your contract) before your contract finishes you should be fine. Assure your employer that you would leave the country (or switch) and not overstay illegally in the country.
