How can I proof my EU partner is excersing treaty rights UK

Im in the process of a civil partnership dissolution. The papers has been forwarded to the district court of which Im not defencing but I m contesting the flase accusations of domestic violence. In order for me to apply for ILR, i need to show my partner is excersing his treaty rights. How can I submit an application when my partner is not co-operating in proving his documents.
