Italian embassy disregard for Directive 2004/38/EC

Hello,

I have read extensively on the subject, but i just would like to take your advice on the matter since many of you are experienced in the subject.

I am a Lebanese, residing in Lebanon. I wish to travel to the Schengen area for 25 days with Italy as the country of entry, i will go for touristic purposes from the 8th of August till the 1st of september with a group of friends.

There is a data collecting agency which collects all the applications for the italian embassy visas called TLS Contact. For the sake of clarity, I am a 24 year old male, unemployed but recently accepted at the American University of Beirut. My father recently got the bulgarian citizenship, therefore I applied to the citizenship too at the Bulgarian Embassy in Beirut. Also, I am still dependent on my father for expences.

I applied to the Schengen visa at TLSContact on july 8th 2014, and the application was received by the italian embassy on July 9th 2014. Included in the application was all the necessary paperwork such as birth certificate, family statement, airline tickets, hotel bookings, insurance, my fathers bulgarian passport copy, a letter from the ministry of justice in bulgaria to the embassy in beirut stating that my citizenship application has been received.

The problem is that to this moment, i have not received an answer, or had any contact with the embassy; and TLSContact do not know any details about my application. Also, my girlfriend who has applied on the same date as I did, got her visa accepted on monday the 21st of august.

The problem is, i am traveling on the 8th of August, and i still need to book train tickets and make necessary plans, which i can only do after my visa is accepted.

As per EU Directive 2004/38/EC, part 2.2.1: “Member States shall grant [family members covered by the Directive] every facility to obtain the necessary visas. Such visas must be issued free of charge as soon as possible and on the basis of an accelerated procedure.” (page 86)

This has not been implemented so far. But my primary concern is i get my visa accepted. So my inquiry is, am I covered by this directive? Thank you

Directive 2004/38 is for family members of EU citizens who either travels with or join the EU citizen.
Unless you are travelling with your father(the EU citizen) or joining him , you can't make use of Directive 2004/38. Your application will be considered as a normal tourist visa and you will have to pay the visa fee.
Fingers cross they exercise some leniency and you get your visa in time for your travels.

Well for the sake of clarity, i submitted the following documents:-pictures
/passport/paid tickets/hotel reservations/insurance/mom's bank statement(100 euro for each day)/a bank statement claiming that my mom will take in charge the expenses of this trip/family statement/birth certificate/proof of residence/mothers proof of work/company circular and my moms social security number/ a paper from the ministry of justice to the embassy of bulgaria stating that they have received my application for the citizenship.

Also, it happens that i got reactivated in university last week, so i submitted a letter from the university stating that i can register in september. Also, my last schengen visa was in 2001 but i have 7 bulgarian visas, just to be clear.

Why do you think its taking so long? It has been calendar days/14 working days. Also, they did not ask me for proof that i will be joining my father.

Have no idea why they are taking so long.
I believe they were closed for the Eid al-Fitr holidays, so hopefully you'll have some answer by the end of the week (tomorrow).

Well, my friends who are traveling with me applied on the 16th and they are going to pick their passports up right now.

Last day of the Eid was on wednesday, well im clueless about what is going on. Maybe it is because i submitted my university letter last friday. But even then they crossed the 15 day limit.

Any help Flyboy?

MY question is I am a Pakistani national who lives in Italy and want to get marry with my Polish GF any one can help me what document do I and my GF need to get registered our marriage.And which office do we need to go and how long does it take?
will be very thankful for help?
