ILR Clock Starts From?

ILR Clock Starts From?

Hi,

I arrived UK as a working holiday maker in Sept 2002. Obtained work permit in April 2004 (in-country) informed by the lawyer. Then received the Work Permit letter and Home Office letter (both dated 2nd Sept 2004, after 5 months wait for the FLR) alongside with my passport with the residence permit stamp on it (Date of Issue: 10 Sept 2004, Valid Until 02 Sept 2009). I was then travelled to USA in Nov 2004 for a week (first time using my passport with the new residence stamp) and returned UK on 7th Nov 2004, so I can see there is a rubber stamp with the date 7 NOV 2004 on it.

So which date should I take as the start of my ILR 5-year journey? I don't think it would be April 2004, however should it be Sept 04 or Nov 04?

I believe it should be Sep 2004

Meaning 2nd or 10th Sept?

As I was informed in April 2004 that the work permit was approved, should the clock starts from the date I had received the work permit OR the date I received the FLR?

Yes I confer, it is 2nd Sept 2004 as the starting date for your ILR ,as that is the date stamped in your passport for your work permit.

I will aim to file my application on 2nd August 2008......if HO removes the retrospectiveness of the 4-5 change.
