Consultancy is stopping my job offer due to Tier 2(G) Visa

Hi All,

I am facing a problem with my Tier 2(G) visa and i think most of them from Tier 2(G) Visa are facing the same kind of problem.
I have been selected by a company and they are ready to offer me a position.
I informed the consultancy at the beginning that I had Tier 2 visa and they processed my CV for permanent role with that company and at the interview time too, interviewer did not ask me about my VISA status. So, I had successfully completed my interviews till managerial round. They are ready to offer me and informed the same to consultancy. Now, I informed consultancy that for permanent role, company has to transfer my VISA or I can work on long term contract with the current visa. But consultancy is telling that they will let the client know that i don't permit to work in UK, but I actually have that. I don't have direct contact with the client and that's why I am unable to inform them on the same.

Could you please suggest what shall I do in this situation ?

Unless your prospective new employer has a tier2 licence they can not employ you.
I am guessing you work for company that gets you contract work and you are employed by them on a basic salary?
Your current visa only allows you to work for your current employer. It is not a transferable document.

Thanks Frontier for your reply.
My new employer has tier 2 license. As I don't have direct contact with my new employer, I am not able to contact them directly and the consultancy, who processed my profile for interview with new employer, is not providing new employer's contact details so that I can talk to them and sort it out. I am not understanding why consultancy is stopping me to talk to the end client ?
Is there any way or proper approach which can help me in getting the offer from the consultancy as they have already got the same from new employer?

And the obvious reason that the consultency does not want you to have the job is they lose out on the deal.

Hi,
In continuation to my previous query, I have some queries that may be discussed before. Sorry, if I am repeating the same. I will be really thankful if someone please do reply me soon as it's really urgent.

1. If you are not getting paid on Tier2(G) by your current employer, is it difficult to get the new sponsor from new employer or transferring the visa status with new COS? I have not been paid for last 2 months with my current employer. Will it be a problem ?

2. Is there any criteria that I should be associated with my current employer for minimum duration ?
E.g, My Current "Employer A" sponsored me on 1st Jan, 2014. do I need to stay with Employer A for minimum 3 months or 6 months or more or less ?

3. What my new employer needs to take care before sponsoring me ?
--e.g. they should advertised the opening 28 days before ? what happened if this opportunity came from consultancy ?

Please suggest me on the same!
If there is already one thread created on these queries, Please refer me to the same.

There is no minimum period of sponsorship
There are no checks against your salary as part of the COS process and if your new sponsor ticks the maintance box you do do have to have minimum funds in the bank.
RLMT will have to be undertaken before they can offer you the job.

You are one of thousands in this trap at the moment. Did you know you would only be paid while you were contracting when you took the job?

1. I don't really get it. Are you saying your tier 2 g sponsor who didn't pay your salary for past two month?

2. There is nothing like that. You can switch your tier 2 g if they provide you sponsorship

3. They will need a RLMT to issue you a cos, unless it's been paid £153,500 or above or if it's in shortage occupation list

There is a major abuse trend where thousands of mostly IT based workers in the main from India have been brought to the UK to undertake contracting roles.
The sponsors are no more than de facto employment agencies hiding under the cloke of the term consultancy.
I had numerous approaches from Tier 2 people in this position.
In essence they are enslaved to the Sponsor earning nothing if they are not contracted out. This is becoming more and more common.
UKVI are trying to root out these Sponsors but there is a retisence from the Tier 2 staff to inform on their Sponsor for a fear of losing their visa. So they sit in silence and hope for the best. The OP is in this position and I hope he can move to another legitimate Sponsor.

@Frontier Mole, thanks for your suggestion. Yes, you are correct and I totally agree with you. People do blunder in their life by doing this and I am one of them. But once you get into this, then only you realize it and think of how to overcome the same.

@North Pole, thanks for clarifying the points.
1. Yes, my current employer not paying salary for last two months and I have completed around 3 months with their sponsor.
Is it a problem ?

About minimum funds in the bank, I have in my india account, Do I need to have minimum funds in my UK account ?
If yes, I can transfer some amount to my UK account.
Please suggest.
