HELP Discretionary Leave to remain Extension DILEMMA

Post by bobws » Sun Aug 24, 2014 10:08 am

Hi
I'm a US citizen married to a british citizen ,got married in the uk in 2011 and applied for flr(m) which was denied .At the time we had a child and i was granted 3 yrs DLR on Feb 2012 . One of the reasons why I was given the DLR was because I couldn't go to the US since my ex husband was making deadly threats . I sent copies of the threatening emails in attachments with the application and cover letter to the Home Office as evidence.

Now we have 2 kids who are both British. The problem now is my husband got a job contract in the US and we all went with him for about 9 months. I was a bit skeptical about going at first but I knew if anything should happen ,he would protect me and kids from my ex husband ( as we still have a few mutual friends who would inform my ex husband of my arrival .)I will never had gone alone. Now my husband is leaving for another contract in Africa and the kids and I are returning to the UK whiles he is in Africa.

My question is I am due to extend my DLR in Jan 2015 ,will this affect my extension since I told them I couldn't go back to the US and ended up there,? Can you all please advice me on how to go about this? Its a bit complicated.

No, you were given DLR as you have a British husband and child, which is still the case.

Thank you for your response Amber.
Initially when my flr(m) was refused, I was asked to go back to the US and come back in with a spousal visa ,that was when I gave them reasons why I couldn't go and supported them with evidence. I thought that was the reason for me getting the DLR. So in this case ,my situation has not changed right ?even after going back to the US.?
