Fiancee visa and marriage location

Post by phjohnst » Tue Aug 26, 2014 7:29 pm

Hello,

I am in the process of applying for a fiancee visa for my fiancee (I am the sponsor, in the UK on ILR, she is in the US as a US citizen).

We are getting married in the US in October, but would like to have her move over here to the UK beforehand if possible, and in any case make it easier to use the PEO appointment to switch onto the FLR.

Is there a requirement that we have to marry in the UK within 6 months, or can we be married anywhere in the 6 month time limit?

Also, does it cause any problems if she does not enter the UK on the fiancee visa before we are married (work/travel schedules may not make it possible for her to come over before we are married)?

Many thanks in advance

The fiancee visa only allows her to marry in the UK. If you intend to marry in the US you should apply for a Spouse visa and submit the application from there after the wedding. This will mean you won't have to apply for FLR(M) to switch from fiancee to spouse.

Even if you applied today - it's highly unlikely a settlement visa would be granted before October anyway.

Just be patient - get married and apply for the spouse visa. When people try and do things out of what UKBA perceives as normal flow is when trouble starts.
