DLR and child benefit confusion

Post by poonamk » Wed Aug 27, 2014 9:23 am

Hi,

I'd be grateful if someone could please advise re claiming child benefits on discretionary leave. My DLR was recently extended for another 3 years (Thank God) and my baby has been granted 3 yrs dependent based on para 305. I'm definitely entitled to claim benefits but my baby has no recourse and the letter also says that "neither you nor your sponsor should claim any benefits".

I'm confused whether I can claim any child benefit now or should I just cancel it? Can this have any repercussion on my ILR application after 3 yrs? I have received one payment so far - should I return this back?

Many Thanks
PK

You may apply for child benefit and tax credits.
