changing job with existing work permit

Hi guys,

I was a student since september 2001 till 2005, and on 5 year work permit from August 2005 till date and been working with my current employer. I am looking to change job now. Could you guys please guide me what would be the procedure if I decide to change job...?

- do I have to go through the same work permit procedure again as I did first time...?

- Do my new employer has to provide all financial documents like my first employer who applied for my work permit first time...?

- or is it just the case of notifying Home office that I'm changing employer and give them new agreement for the job...?

- Whether my new employer needs to produce any documents, if yes then what documents they need to produce..?

I would really apprecaite if you guys could point me to corrent direction and / or can send me any relevant website link if possible.

Yes

No. Your employer needs to advertise the job, then failing anyone who already has a visa/right to work, if they choose to hire you, they need to apply for a work permit from the BIA, providing the same evidence as your first work permit.

Check the application form.

Remember that if you do get a new job and work permit, that you apply for further leave to remain (FLR) again. Did you (remember to) apply for FLR when you switched from a student visa to a work permit?

No. Your employer needs to advertise the job, then failing anyone who already has a visa/right to work, if they choose to hire you, they need to apply for a work permit from the BIA, providing the same evidence as your first work permit.
Not true, sakura. If the leave to remain is still subsiting and the OP will be doing the same job with the new employer as well, then the advertising part for the new job can be skipped altogether. So, the toughest part of the WP process can be eliminated if the advertising is not a requirement.

I second that. For change of employer WP application, the advertisement part is waived provided candidate will do similar job under new employer.

As I understand it, if it is the same requirements (per job description) the advertising bit and all those cumbersome process is not required but I believe a new LTR needs to be applied for within 6 months. Is that right?

Oh ok. I thought they had to do that. But, in any case, it would be like that for most people doing a job that pays more? So, say an Admin Assistant on 20k, then a new job on 25k? Is it as long as the title is the same (e.g. admin assistant), or what about something slightly different (admin manager, on more than the previous salary)?

Guys thanks for your reply. Much appreciated. I already have LTR till Sep.2010 so do I still have to apply for another one.....???

The job was advertised on the national level website so thats not a problem.
My understanding was once work permit is issued. one can change employer (as long as its a similar work) and he/she only need to inform Home Office that we employer has been changed with the job agreement with salary details,etc.

I've been to home office website and have read the immigration section but the language of law doenst go in my head and things aren't stated clearely. and I dont understand that at all.

I dont understand why we have to go through the same process again and spend money for this again. Its seems like money making business for HO. :-(

I have got one more question. If I apply for the WP for the new job and if my WP application gets rejected for the new employer, would I still be able to continue my current job with my current employer provided that my current employer still wants me...?

Meaning that I want to make sure that if my 2nd app gets rejected for some reason then I would be able to work with my current employer on the wp that I already have. Just dont want to take risk of loosing my current wp.
