Status Update- After Appeal Allowed

Applied in December 2012
Refused September 2013
Hearing May 2014
Determination received First week of June 2014

Appeal remitted... Sent back to HO for reconsideration. BUT 

JUDGE PUT HIS REMARKS IN DETERMINATIOM THAT:

"I WAS TEMPTED ORDER ISSUANCE OF VISA BUT IN FAIR BALANCE FOR BOTH PARTIES I REMIT THE CASE TO HO FOR RECONSIDERATION. APPELANT BEEN DEALT POORLY. I DONT SEE WHY HO CANT SOLVE THIS ALL ISSUE IN 4 WEEKS TIME."
ALSO SAID ABOUT REFUND OF £142.00 TO APELANT.

Now anyone know about this before?

Did judge wrote this in anyone else determination.?

Judge saying solve this in 4 weeks time. Judge normally dont mention time frame right.?

May be because my case is from 2012.

I received my approve letter and BRP card, after 1year 1month long waiting.

Applied 24th June 2013
Rejected 16th July 2013
Appealed 24august 2013 (paper appeal)
Decision and determination letter 6th January 2014
Asked for extra documents and determination letter 24/6/14
Approved letter and BRP received 24/7/14.

I see "Fee Refund" in a few posts above. What fee is refunded and why?

I have another question in this regard. I am planning to apply for the T1E visa outside the UK. In case I don't get the visa will the application fee be refunded?

Hi attaghasam,

That is the fee which is refunded after appeal success,
You won't get your application fee back in case you get rejected.

My advice is don't think too much, first of all you haven't applied till now. over knowledge is dangers in this application, it makes you sick. You just read posts which you need, don't read each and every posts.

Smartpen, NO, in this case this is essential knowledge for me. I will be applying for 3 dependents too, so if the fee is not refuned in case of rejection then I will just apply for myself first. If approved then I will apply for dependents, if not I will just lose one appl. fee.

Thanks for your concern anyway, I never get sick from knowledge (over or not).

Good day friends i apply in Sep 2012 i was refuse in Dec 2013,because i sent my son British passport late and is mother birth certificate.Jan 2014 i apply for judicial review and home office withdraw the case,NOW 2 day ago home office send a letter to me to send about 3 documents and i can only get 2 documents pls what can i do.

It is really sad hear my situation is almost same like you nearly 2 years waiting for the documents.
I called twice, sent letter twice and also contacted through local MP. Very unfortunately still no response from HM, I don't know what to do next :'(

Interview called by home office and attend in sheffiled - march 2014

Contact local MP for persue my case - July 2014
Replied from home office to MP and HO stated in reply letter that they will decide my case within four weeks - dated 4th august 2014 .
4 weeks has passed now but m still waiting

Can u please tell me that what replied u for from homeoffice via MP ? What they stated in reply letter ??

I have contacted with my local MP and my business partner contacted with his local MP. Both MPs are sent letter to HM. Partner's MP got reply from HM which says it is under process not sure how long gonna take bla bla bla. My MP still not received any response from HM however MP told me to contact his office if not received any response from HM with in 10 weeks. That 10 weeks going to finish end of this month. Still not sure what is going to happen

Sent letter to UKBA and got back reply from HO in first week of august and since then I been waiting .

@sad.1 do they refund fee in your case?
im very worried. Because once there was an error in my case. If they refund fee i will be alittle relax that they do their job.but no news since 14th july...

Happy to hear that you won after long time struggle.
The thing is that most people are sacrificing huge amount time for waiting documents. Could you ask barrister about these matter, that will be helpful plenty of people in this forum.

Apparently the HO has the right to apply to the Upper Tribunal for permission to appeal to the Court of Appeal within 10 working days. However, the HO representative at the Upper Tribunal informally told me that they normally don't appeal against any UT's decisions. Hope this is true. Anybody has any experiance like this? Please share if you do.

18 months have passed and now I just can't wait any longer to get my passport back with the visa on! Anyways, all the best for you guys who have their decisions/appeals pending!

After read this thread from the beginning, there were a lot of people waiting for their visas after appeal allowed.
Its gone really quiet at the moment, does it mean they got their visas and disappeared or home office hasn't still responded to any of us who won appeal.
