Does RLMT applies for switching from PSW to Tier-2 ?

Hi All,

I completed my Master's from UK University in 2009 & got the PSW (from Feb-2010 till Feb-2012). During that period I was working for various UK based companies. After my PSW I came to my home country & till date working here.

Recently, one of my previous UK company contacted me & are willing to sponsor for my Tier-2 visa. But I am concerned about the Resident Labor Market Test (RLMT).

I want to know does the RLMT exception applies for PSW applying from outside of UK (PSW expired in 2012) ?

The Tier-2 sponsorship guidance says it can (if I interpret it correctly). Please help

I am in a similar position as yours, my PSW expired in sep 2012, I came back to my home country. One of my previous employers have shown interest in hiring me but are unsure about the RLMT. Can you please share your experience on whether your employer was required to carry out RLMT?

RLMT will have to be conducted as the exemption is only granted when the Tier 1 PSW holder is switchin in country and holds valis leave as Tier 1.
The employer would also have to apply for a restricted COS in order for you to return to the UK.
