Employer's RLMT rejected for not advertising in Europe

Post by grif-fin » Thu Sep 11, 2014 12:21 pm

Hi

I am changing sponsor and my new sponsor did the RLMT for 28 days on a website. The home office came back and said you haven't advertised it for other European workers in Europe so you need to extend your advertisement for whole Europe.

Now I cannot find anywhere saying that you require to do so.

Anyone has any idea about this? Maybe Home Office's mistake?

Thanks!

the acceptable advertising methods for RLMT are set out in paras 28.25 - 28.42 of the sponsor guidance:

Thanks a lot manci! like always.

I have read it and still cannot find anywhere mentioning "should be advertised in whole Europe" or anything similar to that...

what is the job?
what did the HO exactly say?
Note that generally it is not sufficient to advertise the job in only one place. at least two are required.

It is Software Engineer role.

I don't have the exact HO quote to be honest. All I heard back from the agency was that the employer got a message from HO saying they have to advertise it for the whole Europe so EU-citizens also have a chance.

It's a big co-operation I'm a bit surprised and suspicious.

the advertising for the RLMT has to be as described in the sponsor guidance - those are the rules, nothing less, nothing more.
