Still travel to UK after settlement rejection?

Post by petrus1983 » Sat Sep 13, 2014 5:29 pm

Today we have heard some terrible news which is my wifes settlement visa for the UK (I'm British) has been rejected because they say they didn't receive information that we can prove they did. That's a different battle, but does anyone know if we can still go to the UK as a tourist to atleast visit while the appeal is going through? She's an American passport holder for info.

Not worth risking unless she applies for a visitor visa and is successful. With the spouse visa refusal on the system she could be 'bounced' on arrival at Border Control in the UK if she travels as a non-visa national. Are you intending to appeal?

Hi - so she's on the 'system' now? That would be bad.

Yes - we'll certainly be appealing, they say they didn't receive supplementary information that they requested regarding my income - when I can prove that they did. Even with 'fast track' this has taken since 5th May to get the decision today and has been extremely testing on us.

Does anyone know how long the appeals process is?

Appeals are lengthy. You could ask for a re-consideration and hope that the Entry Clearance Officer overturns the decision. She would have been on the system as soon as you submitted the application.

That's kind advice. How do you go about a re-consideration rather than just an appeal? I'm losing my mind as I'm stuck in America with my wife pending getting this sorted, but 4 months later I'm getting rather fed up! I didn't know this forum existed until this morning but will hang around and try and help others now as I've learnt a lot in the process so far.
