what should i do next

Post by afterdivorceissues » Sun Sep 14, 2014 1:07 pm

Hello there.

I'm an EEA citizen, female, from Poland, i'm 23 years old

On 27th June 2011 i got married to a non EEA citizen man , after some time of our marriage i found that he tricked me and the only reason he married me was to retain legal stay in UK under family permit visa.I found out by checking one of his Facebook messages talking to a girl and telling her that he loves her and he only married me for visa in UK. i wasn't surprised when i saw that as he didn't treat me like a real wife, i moved aaway after i saw that message and never contacted him again.

I petitioned for divorce at and sent it to court on 15th November 2013 and the petition was issued on 21st November 2013.
after he received the petition he thrilled me and said that i started a war with him, he didn't sign for the papers and i had to send him Process server to serve him the papers but he still played hide and seek which lead the process server company to submit an affidavit to the court saying that he is running away from signing the papers.

a lot of delay took place because of him refusing to sign and running away from process server however my decree Nisi was pronounced on 23 July 2014. and my Decree Absolute on 8th of September 2014.

Now i'm free from him but i really don't want him to stay in UK under my family permit visa. last time i remember he had probation visa of 3 years or 2 years i can't remember. he still travels out and to UK through the family permit visa he got under my name. I don't what else he can do by using the fact that he is still married to me.

Does the court inform the immigration that we are divorced?

How can i tell the immigration office or department that we are no longer married and i'm not responsible for him ?

I'm currently studying in China and i wanna know if there is away i can contact the immigration of UK from China?

Basically what is the next step i should do to stop him from using the visa he got under my name?

I heard that he can still stay in UK and has the right to get residence if he is married to me for sometime (i don't know how long) , is that true?

See here: http://www.lawontheweb.co.uk/Immigratio ... nship_Ends

Drop them a letter with the divorce information.

What action they decide to take is up to them.
