Switching FLR from partner to parent

Post by baloch85 » Tue Sep 16, 2014 7:56 pm

I would really appreciate any advice regarding the matter am in. I am married for 4 and half years and have 2 kids under 5 years of age. I recently got my visa on 10 year partner route as i was an overstayer. My wife and i had some problems recently and she wants to divorce me. We not living togather. I am worried about my kids and wants to knw if i go ahead with the divorce as she is the mother and british citizen she will get the custody and i have to leave the country. Is there any options of me switching my status as i want to be part of my kids life and see them growing up. Thanks

You will be fine, provided you continue to play a role in your child's life.

This can be evidenced by either a court order granting you right of access or a mutually agreed documents confirming that you are playing an active role in the life of child, and you will continue to do so.

If successful, and subject to you passing the English Language test, and have a job, you could vary into the Parent Route 5 years.
