Extending wife's Discretionary Leave

Post by ender5 » Tue Sep 16, 2014 11:00 am

My wife was granted Discretionary Leave (3 years) on October 2011. She was given discretionary leave because we submitted the spouse visa application late. I am a British citizen. We have 3 kids ages 9yrs, 7yrs and 1 month.
I would like some help and guidance in submitting an extension for Discretionary Leave.

1) Is FLR(O) the correct form to use?

2) Do I need to fill in "Section 2 - Dependents who are also applying". Even though me and my children do not need visas (we have right of abode), do they still want information about me and our children?

3) I am receiving Child Benefit, Child Tax Credit and Working Tax Credit. The money goes into my account but my wife's name is also on the tax credit statements/forms. Her Residence Permit does NOT mention "No recourse to public funds". Should I answer yes to question "5.5 Are you receiving public funds?" and how could it affect the application?

4) Since I will be ticking "Other purposes/reasons not covered by other application forms" in Section 3. What supporting documents should I include? My passport, children's birth certificate. Anything else?

Your help and advise will be greatly appreciated.

I am in a similar situation but someone has told me I need to fill in FLR(M) another has told me FLR(O). Any reason why you are not doing FLR(M)?

FLR(M) is incorrect for a DLR extension and could have catastrophic results.
