Hi,
I am currently employed on a Tier 2 (General) work visa sponsored by my current employer (valid until 2017). But, I've decided to change jobs. I've got a job offer from another sponsor who already have a sponsor license. The new job is in the same SOC code but it is an 18 month fixed term contract starting in November. They have already done the Resident Labour Market Test (RLMT).
My questions are:
1) For applying for a new Tier 2 visa using the new sponsor's CoS, will I have to submit my current BRP along with my visa application ?
2) Is the minimum salary requirement in the Codes of Practice the same for permanent roles and fixed term contracts ?
3) Once I get the new visa and BRP, I will resign at my current role and serve my notice period (1 month) while my employers inform the UKBA to have my current Visa cancelled which takes 4 weeks. This process is confusing me. When I apply for a new visa using the new CoS and if I do submit my BRP with my visa application, wouldn't the UKBA cancel the current BRP before issuing a new one for the new CoS ?
4) Also, I would like to go back home on holiday for 2 weeks during this process as after starting in the new role, I will not have the accrued leave under the new employer to do so this year and I still have 11 days holiday left for this year at my current role. What would be the best time to do it ?
Should I get the new CoS from the new sponsor and go on holiday while still employed at my current workplace and apply for a new Tier 2 (General) visa after I return, i.e., in mid-Oct. ?
Or should I ask the new employer to have an earlier starting date in my CoS (say mid-Oct. instead of Nov.), apply for the new visa and go home (India) once I get the new visa for the fixed term contract ?
