Spousal Visa: Meeting Mimimum Income On Irregular Hours

Post by omarinbox » Sun Sep 21, 2014 2:23 am

Hi

I've been working since December in a new job. Its minimum wage but I get overtime on and off but have received it more regularly recently.

My last 7 months payslips meet the minimum income requirement equation in the documents sicne they were revised.

For those on a weekly wage it used to be the lowest month (over the 6 months) earnings multiplied by 12.

Since the revision they have changed the rules to the sum of the income over the 6 months, divided by 6 and multiplied by 12.

I'm going to include 7 months payslips but they will be irregular and I have heard of people being refused for not having guaranteed overtime or for having irregular income. One week I may be doing 48 hours, the next week 70 hours, etc etc

Any consecutive 6 months in the 7 months payslips I plan to include meets the minimum income requirement.

Can anyone shed some light on whether this is likely to be accepted? Have irregular hours been accepted from weekly wage workers doing overtime since the changes in the rules?

The rules haven't been revised as you're suggesting,if you're on salaried income, you still have to use the lowest income.
As your income is not regular and you get paid hourly, you'll be relying on non salaried income, which is your total income in 6 months, divided by 6,multiplied by 12.
If I get you right, you can't use 7 months payslips to meet the minimum income requirement, it has to be 6 months on cat A,except you're using cat B
You can't be refused for not having guaranteed hour or irregular hours, but you can be refused for getting your calculation wrong or not presenting required letter with necessary details from your employer.

Actually I meet the minimum income using 6 months payslips.

I just thought I would put in an extra months payslips to illustrate my income is okay.
