Can British baby enter UK with non Brit passport & no ILR?

Can British baby enter UK with non Brit passport & no ILR?

Hi,

My friend, Malaysian, both are permanent residence in UK (ILR) and not thinking to become British.
They have a baby born in UK and baby can be:
-eligible to be Malaysian and apply Malaysian passport (because Parents are)
-considered as British automatically and eligible to apply British passport (because the law says so)

However my friend would like the baby to be Malaysian so family stay together.
Now they want to go oversea, all of them travel with Malaysian passport.

Question is when they return, at the immigration control, would they allow the baby to enter UK without ILR in baby's Malaysian passport? Bear in mind the baby is considered British.

Experts can tell you clearly. But common sense dictates that any passenger entering or leaving a country must either have a passport/travel document, and a visa if the country they are entering requires a visa from the the country they are travelling from.

So I think its a simple case of either getting a British Passport or getting a Malaysian one with ILR visa from UK, as I don't think baby is automatically a British citizen if parents are on ILR.

Malaysia doesn't allow dual nationality so I would advise against applying for a British passport. Better to get a Malaysian passport and apply for Certificate of Entitlement.
