When to apply for Permanent residence? Please help

Hi Everyone,

I have been searching answer but different people has different answer for what i am looking for. I am a non EEA national married to an EEA national on 07/2008. My visa which is a residence card (family member of EEA national) Received on 09/2009 and expiring on 20/10/2014. We both have been living in the UK since 02/2006. The home office requires that I can apply for permanent residence once I resides in the UK for a continuous period of 5 years. My simple question is what does the HO mean for the 5 years period? Does this time start from my arrival in the UK OR from my marriage date OR when I received my residence card?

I will really appreciate, Please help.

Hi sheraz thx for reply. mate I just wanna know if your answer is for sure i mean is it 100% true or have you heard or read somewhere. please dont mind me but i really wanna be 100% sure before apply.

I would also like to ask one more question if you can help me with the answer please. The home office also requires that the EEA national must exercise her treaty rights for 5 years, I just wanna know if we can include my wife's work history starting before our marriage or after that?

Just keep in mind that EEA2 RC is a mere confirmation of right to live for a married non-eu national with a qualified EU national.
If your EU national partner after arriving in 2006 started exercising treaty rights for five continuous years then she may have already been eligible for PR in 2011.

Hi sheraz,

When my wife came to the UK she did not registered herself with HO (WRS). She first started to work from 06/2006 to 12/2007 with no WRS. Then from 12/02/2008 to 10/10/12 with WRS and since then she has no job (she looks after a baby). Can you tell me please what is the best period to show that she was excercising the treaty rights.
