Hello guys i am a silent follower of this board,i need some help regarding my case,i was a student here for some reasons i did not went to uni so i got the letter from home office saying my visa has been cancelled and last date to leave the country or to apply for a new visa by 07 june 2013,i have applied for flr(o) on 07june 2013 with a covering letter from my wife saying we are going to get married and all,my wife is british and was married before and we were waiting for the decree absolute certificate from court, in the mean time h.o have refused my flr(o) in sep 2013 with full appeal rights,i have made an appeal on 06 sep 2013 and got the hearing date in april 2014,but i got married in dec 2013 and my solicitor have withdrawn the appeal from court on 30 jan 2014 and applied for flr(m) on 10 feb 2014 on same day service they took all the paper work and said they will get back to us,and on 07 march 2014 we got a letter from h.o asking for my wife's passport and the documents to show that we have been cohabiting since we started living together which was 11 months,so i have sent them straight away and on 14 march 2014 we got a letter from h.o again asking to come for interview on 30 may 2014 in liverpool,we have been there and the interview was for 2 hours seperately and in that interview we have given 11 different answers some of them are silly,and my visa got refused on 07 july 2014 on the basis of interview and said we are not genuine and not given any appeal rights,they have given 1 landline no and ask me to ring them by 24 july 2014 to make arrangements to go back,on 20 aug 2014 we have made pre action protocol asking to give in country right of appeal or consider the case as we have corrected all the answers which was in refusal letter other wise will go for judicial review but on 03 sep 2014 got a reply from them saying we are not considering and come for judicial review....... on 19 sep 2014 we have been to our local mp and asked him to write a letter to h.o to consider the case... so guys please help me out my last date to apply for judicial review is 07 oct 2014.and my local mp said that i have to wait for at least 2 weeks,so i just want to know shall i go for judicial review or go back home and apply for a fresh visa,some solicitors are saying i will get appeal rights if i go for judicial review some are saying go back dont know what to do.and really sorry for writing the whole story
To sum up:
1. Had student visa, didn't study.
2. Met married woman
3. Applied FLR(O) rejected
4. Married said now-divorcee
5. Applied FLR(M) rejected
Seems to me that as you had no status you'll have to return home and apply from there, seemingly no children involved so what can you not do that? Easier and quicker in the long term....
