Hi Folks,

I am in a bit of situation and i was hoping someone over here would be able to help.

I work for a multi national companay that sponsored my ICT application to work in UK for the UK office. Now my work permit that was granted in August 2011 has expired ( in August 2014 ). I travelled back to my own country in May 2014 , becuase my work finished, howevernow in september there is a requirement for me to re-apply. Out of these 3 years of valid visa period , i have only stayed in UK for 2 years

Furthermore, (this might sound silly but) Does this apply at me at all. Because my first ever work permit to UK was back in 2009 which experired early 2011. Having an initial work permit in 2009 have any advantage or disadvantage to me , when we consider the rules were changed in 2010/2011.

Work permit 1 : May 2009 - Aprill 2011
Work Permit 2: August 2011 - August 2014

So my questions are:

1) As per my understanding Cooling off period is in effect after 5 years of stay in UK? is it still the case?
2) Does Cooling off period apply on me? If yes, what things i need be aware of next time I apply (if i do in an years' time).


i hope i am clrea enough in description . Any help would be appreciated.

I'm assuming you had a ICT Long term visa when you were in UK last.

In that case, you will be subject to a cool off period of 12 months starting from the day you left UK. It means that you cannot apply for another Tier 2 application until May-2015 (since you left UK in May-2014).

Aug 11 - May 14 is more than 2 years

did you leave the UK in Apr 11 and was "work permit 2" a T2 ICT Long Term Staff visa for which you applied from abroad?

no, 1 year cooling off applies to T2 entry clearance applications (from abroad) if the migrant had T2 leave in the UK beforehand. The 1 year is counted either from the expiry date of the previous T2 visa or from the departure date from the UK (in your case May 14) whichever earlier.

if you plan to stay with the same company the period of engagement given in the Cos can now be 5 years and, if it is, you can apply for a 5 year visa
