Family Visa for Unmarried Australian Partner (living <2yrs)

Post by manckiddoh » Wed Oct 01, 2014 9:12 am

Hi everyone,

I hope someone can help guide me :-)

My situation is: I am a British citizen, and I have been living with my Australian girlfriend for 2 months in Sydney (met Jul-13, 14 months). We are visiting England in December and would hope that I could find a visa for her where she can remain in the UK to work or study for a year.

Looking at the Partner route of the "Apply to remain in the UK with family" Visa, it says we need to prove one of the following:

-you’re married
-you’re in a civil partnership
-you’ve been living together in a relationship for 2 years
Source: https://www.gov.uk/remain-in-uk-family/eligibility

Although we are not married and have not lived together for 2 years, we do have a Registered Relationship document in NSW Australia (New South Wales Civil Partnership Declaration). My question is: Would the UK Immigration consider this to be satisfactory evidence of a relationship/civil partnership, therefore we could apply for this Visa on landing in the UK?

Thanks in advance,

Tom

You need the full 24 months, UKVI won't move on that.

If your partner is under 30 she can apply for the Youth Mobility Visa.
This gives her a 2 year visa and she will be able to work. If you move back here and live together for the duration of the visa you will then be eligible for the unmarried partner visa or the spouse visa if you decide to take that step.

She's 31 so not an option, such as shame too as would have been so easy! :-(

Visitors can't apply for other visas while they are in the UK. She would need to do that from Australia.

Sorry but that isn't the case. For the remain-in-the-UK Visa, you can only apply in the UK

There is no "remain-in-the-UK Visa". Those who enter the UK as a Visitor, are not allowed to apply for other visas while they are still in the UK.
