Switiching from Tier 1 Entrepreneur to Tier 2 General

Hello Members,

I have a really important query and I need your advice. I was on PSW visa which expired in mid August 2014. I was working as an Assistant Accountant with someone who didn't have a Tier 2 License. Few months before my visa expired I started to look for other jobs but unfortunately couldn't find a job with a Tier 2 registered firm. Few days before my visa expired I decided to apply for Tier Entrepreneur Visa. I gathered all the relevant documents and applied for it but my intention always has been to find a job with a Tier registered firm. I took advantage of the fact that until a decision has not been made on my pending application my status will remain the same ( PSW Visa).

A few days back I applied for a job with a Tier 2 Registered company and I told them that I am on PSW visa. They are willing to sponsor me if i am the right candidate. The interesting thing that happened today was today by the Grace Of Allah, my Tier 1 entrepreneur visa was accepted and I received all my documents which i sent with the application.

I am in a tricky situation now as my interview for the job is tomorrow and now that my status is Tier 1 Ent , I think the labour market test will apply on me. Have you guys any idea if this labour market test can prove to be an obstacle and how can this hurdle be cleared. If i had not been granted a visa today , then my thing would have been pretty straight forward as I would have withdrawn my Tier 1 ent application and applied for a Tier 2 application.

What to do guys??? Suggestions would be really appreciated.

Unfortunately you can't go back now and you would need to meet all the requirements for Tier 2 (RMLT, Job code etc...)

Check out the job advert for the new position with the employer to see it meets the criteria for RMLT (Job title, location, salary, skills/experience, job main responsibilities, days advertised for) and also where they were advertised.

I hope this helps. I totally understand the frustration given that I'm pretty much in a similar situation.

The position is for the place of Semi Senior Accountant, their salary offers meet the Tier 2 requirement but they only only advertised on Gumtree.
How long have you been on Tier 1 visa buddy ?

Hi,

From my little knowledge on this matter, once you have applied and been approved for Tier 1 Ent, your visa and BRP will state that you have no right to work except in the business you are working on. Therefore, no other way buddy than to continue with Tier 1. Except you want to contact UKVI themselves in order to pick their brains on the matter.

The employer would need to place the advert on Job Centre Plus as well for at least 28 days continuously, otherwise HO won't approve the CoS and make sure you're offered at least the minimum salary required for experienced skilled worker to be on the safe side. Do you really want to switch to Tier 2? I wouldn't do this if I was in your place.

I was on Tier 1 for 1.5 years before switching to T2G.
