Dear experts,

Sorry to trouble you. I just have a quick question and I would be very grateful if you could answer the following query.

I'm currently appealing for the refusal of my Tier 2 General and the hearing date is on 1st Dec 2014. In case my appeal is unsuccessful, could I make a fresh Tier 2 application via the premium service within 28 days as soon as I received the FTT decision letter?

Hi,

As per your question, once you have right of appeal, then FTT will be giving you 5 days from the date of receipt of the decision letter to make a new application or go back for further appeal. Therefore, if you can do a fresh application right now and you know the appeal is not gonna work in your favour, you should do a fresh one unless you just want to buy time for any other document you might want to source to accompany your application.

Thanks nothappywithukba for your reply. My solicitor says that we have a decent chance of winning the appeal, however preparing myself for the worst case scenario.

Does it state on the FTT decision letter that I can re-apply within 5 days?
