Possible mistake on UKVI website

Post by nickmpco » Mon Oct 06, 2014 9:11 pm

Hi All,

I am applying for a Tier 2 general visa and I think that UKVI has made an error (or has an error on their website). I am a tier 4 dependent and sent away my application a few weeks ago. My employer issued me an unrestricted CoS. I phoned UKVI today asking whether or not I was supposed to be issued an unrestricted CoS and was allowed to apply in country. They said yes. On their official site, there is a list of those that can switch in the UK, and tier 4 dependent is listed: https://www.gov.uk/tier-2-general/switch-to-this-visa

As it happens, my employer was required to issue me a restricted CoS and I was to be treated as an out of country applicant. The case worker was kind enough to let me continue to apply in the UK so long as my HR department issued a restricted CoS so it seems it is all sorted from my perspective. Was the case worker incorrect? Is the website incorrect? Or am I misinterpreting this entire situation.

Thanks

dependants of T4 migrants can switch in-country to T2G but they need a restricted CoS. See para 58:
