Hi all,

Can all the gurus or moderators confirm that the FAQ and particularly this question is still correct?



Q2: My spouse was granted ILR as a dependant. When can he/she apply?

Once a dependant is granted ILR, he/she is not a dependant any more. For naturalisation, each applicant needs to meet the requirements (including the 5 years residence period). There is a reduced fee when applying together.

If one applicant meets the 5 years residence requirement but the spouse doesn’t, then once the applicant is granted BC (after the citizenship ceremony), the spouse becomes a spouse of BC and can apply for naturalisation under the 3 years residence requirements.





The rules for settlement when married to a British citizen changed in July 2012 which changed the residency period from 3 years to 5 or 10 years, does this apply to naturalization too?


And also if one has been naturalized in 2014, and a non-eea memeber partner has acquired indefinite leave a couple months later after her partner has been naturalized, will this partner can apply straight for British citizenship after receiving his indefinite leave and not wait the 12 months period?

If the spouse has completed the 5 year residency period and has ILR they can apply for BC immediately their spouse has been granted Citizenship.

The reduced fee reference can be removed as it's no longer relevant.

Casa thanks for your answer.

The spouse had 5 year residency and has ILR, and the wife had been naturalized before that, in 2014.

But the question is, wouldn't the new requirements apply to someone who has become British citizen after 2012, ie 6 years as opposed to 3 years for dependent of a British citizen (the change occurred in July 2012).
