Having decided to get myself an EEA Family per,it to visit the UK with my wife and just for the sake of having it, I filled out an online application on the 3rd of October. Today I had my appointment to which I want equipped with my passport, marriage certificate, signed application and a photo of me. I forgot at home copy of my wife's passport. The first thing the embassy employee behind the window told me was, where are the wedding photos, proof of your relationship with your wife, evidence that you are in a relationship? What supporting documents have you brought with you? I said this is all I got, wondering what she was talking about. She would answer me by saying that I should referred to the ukba website before coming and that my application would most probably be refused but that's not for sure, so I told her I would send or bring any documents they would require. After taking my biometrics and a photo of me with a standalone camera, she told me that my application will be processed within 15e working days and then my passport can be collected. I then told her I needed my passport as I'm required to be in possesion of it at all times, that it is my only identification as well as proof that I'm staying legally in Poland as I have in it my Luxembourg Issued Schengen visa, she would tell me then that thousands leave there passports there and that what I was saying was untrue, I also mentioned I needed my passport as I was going to Lithuania today which I canceled, then she pulls out a paper on which she asks me to sign that I'm withdrawing my application and that I'm aware this would lead to my application being refused while telling me 'Nobody is forcing you to apply for a visa!'. Unfortunately I signed and asked fyor a written confirmation that I was denied the right of lodging an application because I didn't wanna leave my passport, she then said nothing like that existed and that they wouldn't give me any proof. I'm shocked at how unprofessional, rude and vulgar she was, even more mad at my ownself for having allowed such a thing to happen, not standing up for myself like I should and allowing her to breach the citizenships directive. I will file a complaint against her, submit a new application with only my wife's passport photocopy and our marriage certificate without leaving my passport wondering if I will end up scuffling with the security or how this would end. Please provide me with your advices and any knowledge I should equip myself with befoe going there. Worth mentioning is she offered me to withdraw the application for the lack of supporting documents suggesting my application would be refused. Thanks

I know she was rude, but if you don't provide a passport, where do you expect your visa to be affixed.

The memberstates are entitled to take a reasonable time to process your application. You cannot expect to go and get your passport on the same day.

Thanks Obie. I wasn't expected to get the visa in the same day, the 15 days are needed to process my application not affix the visa. I expected that they check or photocopy my passport and when it's time to affix the visa I would come and bring my passport. It doesn't say anywhere in the directive thatvmember states should or can hold onto applicants' passports while there applications are being processed. At least denying me the right to lodge an application for that reason is a breach of the directive if I'm not wrong. Member states not only are obliged not to turn people away at the border when they prove their relationship but even if the non-Eu nation is not in possesion of a passport. She added that all embassies do that and when I answered her by saying that wasn't the case last month with the embassy of Luxembourg she went on with saying, this is the embasy of the UK.
