Non-EU RC Holder traveling back to the UK alone

Post by cheekybeauty1 » Sun Oct 12, 2014 10:24 pm

Hello,
I am an Italian citizen exercising treaty rights in the UK. My partner is a non-EU residence card holder. We are planning a trip to Europe with the ferry or Eurotunnel for a long weekend for leisure. My non-EU partner may have to return before I do to the UK so he will be traveling alone either on Eurostar or as a foot passenger with P&O. I will be returning two days later.

Will this be a problem?

He will come prepared with all our documents including a copy of my return tickets, bank statements, a recent household bill, etc. so as to minimise any hassle that he might get at the border.

We have looked through the forums and on the UKBA website and it says that for him to travel outside of the UK alone, I have to be in the UK. Does this mean I still have to be a resident here or that I physically have to be in the UK whenever he travels out of country? He reads it literally--that I have to be in the UK whenever he travels but I think it means that I still have to be a resident of the UK. It makes no sense that I would have to physically be in the country whenever he travels. What if we both had jobs that required us to travel frequently?
