I am an overstayer been in the UK since 2002, came in as student then in 2005 was refused visa so just stayed illegally in the UK since. In 2006 met my husband and we gave noticed for married in August 2012 and got married in December 2012. I was arrested in September 2012 working illegally with bad documents taken to detention, I was then release on temporary admission in October 2012.
I put in a spouse visa application using FLR (FP) the ukba accept my relation is genuine and subsisting and was refused on the basis I overstayed my visa and they said I can go home and applied for the correct entry clearance. I am willing to go home as we satisfy all the rules financial, home to live, and genuine relationship..
My question is as I was arrested whilst working illegally with bad papers will I be refused entry clearance if I go home and applied for visa?
I understand been working illegally is criminal offense how long will I be banned to enter the UK because of this crime?
I am married for almost 2years will my criminal offense be not consider since I will be applying for spouse visa?
what else can you advice me am very frustrated at the moment please any help is appreciated.. I don't have any children..
