new child tier 2 general

Post by mando112 » Wed Oct 15, 2014 9:00 pm

Hi All,

I have read the rules regarding newbors in the UK but unclear on some areas and the new .gov website is nowhere as good as the old ukba website which detailed everything.

https://www.gov.uk/tier-2-general/family-members

I am having a baby next year in March so wanted to know the following :

1.does he/she need to have visa to be legal here? if not can you please send me a link or tell me where I can find that on a UK official website ?

2.what would be his/her nationality status ?

3.Reading around , he will be legal here without visa and visa is only needed if the baby is to travel outside the uk . My visa is up for renewal in May next year so I guess If he is legal here indefinitely without visa, I could obtain his/her visa after i get my new visa thus I don't end up paying £600 for her/his initial visa to renew it again in 2 month ?

4.do I have to pay the full dependent fee for him/her which is around £600 ?

5.is he/she subject to any UK immigration laws that I am to ?

6. do I have to have maintenance fund for him which is around £600-700 i think for 90 days ?

many thanks

No. The baby can remain in UK as your dependent without a UK visa. Visa will only be required if he/she travels out of UK and wants to come back.

2.what would be his/her nationality status ?
Same as parents.

3.Reading around , he will be legal here without visa and visa is only needed if the baby is to travel outside the uk . Yes. You can take this approach.

4.do I have to pay the full dependent fee for him/her which is around £600 ?
Yes, you need to pay the same fees as any other dependent.

5.is he/she subject to any UK immigration laws that I am to ?
Same as any other dependent.

6. do I have to have maintenance fund for him which is around £600-700 i think for 90 days ?
Yes, same as any other dependent.

many thanks

Check this: https://www.gov.uk/tier-2-general/family-members

Check the section "Children born while you’re in the UK". It mentions you "can" apply for a visa, but you "must" apply if you they want to travel in and out of UK. Something similar might be mentioned in the guidance notes as well. Need to check.
