Tier 2 ICT to ILR

Hi, My first Tier2 ICT stamp date is: 22nd March 2010. Current Tier2 ICT expiry date: 14th Feb 2015. As ILR can be applied before 28 days of 5 years completion, am I eligible to apply for ILR directly or do I need another extension. Appreciate if you can suggest at the earliest. Thanks.

Yes you are eligible for ILR as 5 years spent on Tier 2 ICT given the Tier 2 ICT was assigned as per rules before April 2010 whicf in your case is true. Read part 6A document of immigration rules section 245HF(c)(x).

I think you can make an application but since your visa is around 1 month short to total 5 year period then it is up to the case worker to see if he wants to consider it or not. So I will say that you hire a good solicitor and then do your application as a solicitor can put your case more firmly than if you represent yourself.

But safest way is to extend your visa first as it will give you full 5 years stay and then there will be no grounds on the rules mentioned in part 6A document to refuse your application.
