Tier 2 (ICT) to ILR

Hi Experts,

I got m initial ICT Tier 2 visa in April 2009 (initially it was rejected but after admin review it was approved in September 2009 and visa stamped with start date of April 2009) and first traveled in Jan 2010. Since then I am in UK with same employer and getting extensions ( got twice once in 2012 for 2 years and then in 2014 for 2 years as well). My current ICT Tier 2 visa will expire in 2016.

I understand that in ICT Tier 2 case the ILR application can be submitted 28-days before the exact 5-year period. But since I did not enter UK in first 90-days of my entry clearance visa issue in April 2009, Will this restrict me in applying 28-days before? My five years will complete in Jan 2015, but can I apply in Dec 2014?

You may apply for ILR (245GF) up to 28 days prior the 5th anniversary of your initial entry and before your leave expires.
