Hi,
I am currently employed in UK on a Tier 2 (General) work visa sponsored by my current employer and valid until Jan. 2017. However, I've decided to change jobs (under Tier 2 (General)). I've got a job offer from another company who are willing to sponsor me under Tier 2. They already have a sponsor license. The new job is in the same SOC code but it is an 18 month fixed term contract starting on 3rd Nov. 2014. They have already passed the Resident Labour Market Test, having advertised the job for the last 2 months before selecting me for it.
My questions are:
1) From what I've read on this web board, I should first use the new CoS from the new sponsor to apply for a new Tier 2 (General) work visa. For this, will I have to submit my current BRP along with my Tier 2 (General) application ?
2) Also, would I have to show maintenance (funds) and English language proof again ?
3) Is the application process and minimum salary requirement the same for permanent roles and fixed term contracts ? From the UKBA's codes of practice, the role I'm applying needs a minimum annual salary of £29,600 and I've been offered £30,500. I reckon this should be sufficient to get the 20 points for Salary.
4) I also read that once I get the new visa and BRP, only then should I resign at my current role and serve my notice period (1 month in my case) while my employers inform the UKBA to have my current BRP and visa cancelled which takes 4 weeks. This part is confusing to me. When I apply for a new visa using the new CoS and if I do submit my BRP, wouldn't the UKBA cancel the current BRP before issuing a new one for the new CoS ?
5) Also, I would like to go back home on holiday for 1-2 weeks during this process as after starting in the new role, I will not have the accrued leave under the new employer to do so this year and I still have 11 days holiday left for this year at my current role. What would be the best time to do it ? Should I get the new CoS from the new sponsor and go on holiday while still employed at my current workplace and apply for a new Tier 2 (General) visa once I return ?
Or should I ask the new employer to have an earlier starting date in my CoS (say mid-Oct. instead of 3rd Nov.), apply for the new visa and go once I get the new visa for the fixed term contract ?
