Spouse Visa for the mother of British national Child

Post by laeeq99 » Tue Oct 21, 2014 11:40 am

Hi there,
thank you all for doing/carrying on with this wonderful work.

I needed an advise from you guys.

I am a British National. My son was born 2 years ago in UK when I was on ILR. My wife was on dependent visa. I decided to move back to my native country last year. But unfortunately it didn't work out. So I decided to come back.

My wife was on dependent visa and it ran out this year in April.

Now the situation is, I am british national and so is my son but not wife? I want to ask if we have to fulfill all the requirements as family dependent visa or there could be done something on human rights grounds since my son is british and he wants to reunite with his father?

I came here last month and luckily found a job and started it. I have not yet received my first salary. But my wife and kid are still in native country living with my parents. My son is almost 2 years now.

Any advice would be highly appreciated.

Regards,

well to be honest, no savings. But salary £40k+

But I can deposit some money in home country where my wife is. But not in UK accounts since I was not here.

You will need to find a job in the UK that will get you 18.6K or more per annually or save up to 65K for you to be able to bring your wife back to the UK.

I did mention in my initial post and in the last post that I have found a job of £40k+. But what I want to ask that is there a possibility of bringing my family here earlier than waiting for 6 months salary slips and statements?

Thought the 40k is the overseas earning.

If you were earning the 18.6k when you were overseas, then yes. Otherwise, no.

Thanks.

actually I was contracting for a UK company (working from overseas) and was working as self employed and yes I was earning over £18K+/year. The company was transferring the money to my UK account but I don't have any savings. Does it matter? Would that money count towards the financial requirement(working as self employed)?

It would count if you are coming to the UK with your wife.

But right now I am in UK. And found a full time job here and just wanted my family to be here.
