I currently live in Malaysia , But I live in UK before for about 6 year (visitor visa after overstayed) .I got a son who born in UK Dec 2007 , He have British birth certificate, But he didn’t have British passport because at that time his father only hold 5 year resident visa not Permit Resident (he is asylum seeker form Afghanistan) ,I believe he now already got his PR . I have split with me son father long time ago never had any contact now , I bring me son back to Malaysia since April 2009 . My son now hold Malaysia passport . I try to apply my son a British passport but British embassy at Malaysia had told me they will need his father passport copy . ..

Is there any other way can get my son a British passport or Resident with my situation at the moment ? Was hope he can have a change study and live in UK . have some people told me have a look the ‘’ Right of abode ‘’ it my a change . But i not sure am I entitle to apply this ? Or it will need more supporting document to proved of ?

Many thanks for you guys take time to read my email .Any advise will help.

Best regards for you all

If neither parents were settled when child was born, then child is not automatically British. Registration is first required before child may apply for a British passport.

As stated above, just register the child on form MN1 first.
