Rules on Visitors Visa - UK visas website

Post by Please help » Sat Aug 25, 2007 7:30 pm

Can anyone give me the link to the detailed rules on visitors visa to the UK?

I thought I understood them but obviously not since my girlfriend was rejected twice and I just want to understand more.

Thanks,

Can you give us more details? Where is she from? What is your own immigration status?

Thank you all.

It's quite complex.
- I am British
- My girlfriend/fiancee is South African

We were together a year while she was on her 2 year working holiday visa. She went home due to end of visa in April 2007. Her dad bought her a ticket to see me in June but she got turned around at Heathrow, I went to be with her in South Africa applied again but it failed.

I have decided I want to marry her and will do so in September and we will apply for a sposue visa.

I have a home, financial status good (£30,000 in cash and unit trusts; at least £90,000 of equity in my 2 bedroom flat and a salary of about £21,000), I have a home, relationship genuine, her old employers have wrote me a letter to say that they would very much like her to work for them again. I have all the evidence for above.

Problem is that I didnt explain to my girlfriend how serious I was about her and she told the Immigration Officers that she couldnt see us marrying and I had said that I do intend to marry her. Now I have to explain the inconsistencies. Basically I need to explain that whilst at that point in time her intentions were just to visit for under 6 months, not to work etc now they are to live permanently with me as husband and wife.

The truth is I will be with her in the UK or South Africa but we want it to be in the UK.

After you marry in September, she can then apply for a 2 year spouse visa. The information you will need to send includes evidence that you can support yourselves without recourse to public funds (sounds OK!) and in your own accommodation (also sounds OK) and that your relationship is genuine. To support that, you can show wedding photos / invitations / proof of time you've spent together, etc.

Many thanks for your reply.

I think the hardest thing is trying to put into words what went wrong with these visitors visas and how we have gone from applying for temporary residence to permanenet residence.

My parents are also scared of flying so whilst they have sent me a letter of support for the marriage they wont actually be there. I hope that doesnt affect teh application.

We are also trying to keep the wedding modest so that we have sufficient money to take our case to court if necessary.

Make it a strong enough application, and you shouldn't need to go to court. ANy evidence you have of contact (letters, emails, phone bills) would help. I don't think you should panic.

Thanks for the advice.

It's just difficult not to panic...I have been without her 5 months and I just want her to be with me asap.

I hope that they dont have any problem with me submitting the application a day after us getting married.

They won't, that's pretty normal.
