ILR refusal's impact on Tier 2

Post by jollyjoker » Mon Oct 27, 2014 7:40 pm

Please can you comment on the below theoretical scenario
- Tier 2 General obtained in 2009 (so before the April 2011 changes)
- Worked abroad for several months at the same employer/sponsor's overseas office. Salary paid overseas. Total stay abroad exceeds 180 day but can be split into 2 so that each year has less than 180 days
- Extended Tier 2 successfully again with the same sponsor
- If ILR is refused on long stay abroad, potentially due to having worked abroad, would that have any impact on the Tier 2 visa ?(assume Tier 2 valid well beyond ILR application date) Is there a risk the Tier 2 can be revoked? Or would the post-April-2011 rules apply in this case?

If your ILR is rejected for some reason, your current visa will continue to be valid as long as you've not crossed its expiry date.
