Tier 2 Application and ETS/TOEIC .

Hi

I applied for Tier1 Entrepreneur in December 2012 got refusal in May 2013 due to documents and my FTT appeal was also refused on Jan 2014 .
i finished my Msc in feb 2013 and was graduated in Nov 2013 and kept applying for job during this court process and found a job with tier 2 sponsor now i have applied for Tier 2 since may 2014 and waiting for a response but my question is that the TOEIC certificate which i attached with my tier 1 application will affect my application or not as they are simply refusing those used TOEIC certificates to get visas previously . Does it affect my case even though i was not granted any visa on the basis of that certificate and now i have attached my Msc Degree with my Tier 2 application for English Language Points .

Thanks in Advance for any expert opinion .

How long does ETS hold voice recordings for TOEIC?
They say they cannot re-score after 3 months and they hold scores (not voices or paper answers) only for 2 years.
Does it mean the voice recordings are not stored for more than 3 months ?

The Home Office letter says - "ETS has a record of your speaking test" and "On the basis of information provided by ETS, .........".
