Benefits for DL VISA

Hi,
My case is quite complicated.my husband is British & we got a son who is 1 year old & he is British too.im on discretionary leave & got renewed in 2012 ,so I gonna apply for ILR in dec2015
For the past two years my husband was claiming HB,CTB,CB.WTC,CTC as a single parent for himself & our son
I was workin full time .now he has stopped all the benefits & has started to work full time
So when I apply for my ILR does it create any problem for my visa,as we both work full time now

Can anyone pls help bcos I'm so worried
Can I just inform the council & payback the money
My husband was taking care of our son while I was working away frm our home
I just come back home in the weekends

As I was on DL visa & under immigration control we thought I cant apply for benefits .as my husband was out of job he applied for benefits for himself & our son
