Spouse Visa Advice...Pls help me

Post by jayjemae » Tue Oct 28, 2014 10:57 am

Hello,
I am tier 2 general visa holder and I want to bring my wife here in UK..We're Filipino. and she's working in Kuwait at the moment. We have two children but they are in the Philippines with our parents. But I want to bring my wife first due to financial requirements of UKBA :(. My contracted hours is 40 per week and my annual pay rate is £16,244 not to include my over time.. In 2013 I earned £19,390 (based on my p60) and £21,975 for 2014.

My question is. Am i qualified to bring my wife here since my basic rate doesn't meet the minimum requirements of £18,600. but its clear from my p60 that I earned more than that. I can support that with my present payslip...

So far I have the other requirements:

Employment certificate
Payslip
Tenancy agreement ( I am renting a double room)
My wife passed the English test

Note: We're not bringing our children yet. But as soon as we're settled and we're renting a house or flat on our own and we're financially stable we will bring them...

Looking forward for your help. Thank you so much

For your wife, you will need to show saving of £630 held in your account for the past 3 months.

For additional children, there is an additional £630 for every child.

Thank you for your reply...

How about my salary? which is £16,244 per annum. But as I said I am earning £18,600 or more due to my overtime. I can prove it by showing my p60 and my payslips... Am i qualified to bring my wife here? thank you

thank you vinny...

from this website https://www.gov.uk/government/uploads/s ... rement.pdf....

It is stated there that The annual income should be £18,600. As I mentioned on my post above. I am earning more than that including my overtime... But if they will just consider my basic annual salary, It will be less than £18,600.

Will they consider my overtime to be qualify on on this requirement?

Thank you.... poking forward on your reply....

That is only for ILR holders and British citizens to sponsor their spouses/ dependents. You are trying to sponsor a PBS dependent. Totally different.

Just curious, when did you originally get your Tier ? Are you being paid what it says on your CoS? When/ if you apply for ILR, you will need to meet the income requirements (between you and your spouse if she can find legal work in the UK as your Tier 2 dependent) to sponsor her and your two (non-British) kids as dependents of ILR holder/ Brit citizen.

No you do not qualify for ILR until at least MAy 2015.

You should perhaps seek legal assistance, if you are having difficulty comprehending the advise i have given you.

Thats what I thought about applying for ILR (I will be qualified on may 2015.) At the moment my focus is to bring my wife here as my dependant.

You made it clear for me about the PBS dependant. Thank you so much...

But anyway since we talked about ILR. Will I be qualified on may 2015 with the annual salary that I am earning? ( as I posted above?)
