Nursery Fees Salary Sacrifice Scheme on Tier1 General

Hi ,

I am on tier 1 visa (Main application and will be eligible for ILR in 4 months), I have been claiming childcare vouchers for my son's private nursery place.

My wife's (Tier 1 - Dependant) employer provides "Nursery Salary Sacrifice Scheme" in which they deduct full nursery fees from her salary before tax and they will pay childcare provider directly ,saving Tax and NI. We are not claiming child tax credit.

Could someone clarify following queries please?

1. Is it ok to join this scheme , being on Tier1 visa?
2. Is it against the clause "No recourse to public funds"?

It is not Public Funds!

Note
But remember you are getting less salary normally childcare vouchers reduced the salary which may results you are unable to meet the earnings points in ILR later.
e.g. Gross Salary-Childcare Vouchers= Taxable Salary
and points will be awarded on Taxable Salary for ILR
