ILR RULES FOR PEOPLE WHO CAME BEFORE 9 JULY 2012

Hello All,

I am Hamid Rana. I want to some advise on my case but please first read the my whole story. I came in this country in July 2004 on a student visa. My wife got dependent visa from British High Commission in Islamabad and came in this country in May 2006. In July 2007 we've got our first child in UK. Then our second child was born in April 2011 and third child in April 2014. I got my ILR just recently couple of weeks before on 10 years long residence. Now I am applying for my children's registration as British Nationals by using MN1 forms.
Now the questions are :

1) How to apply ILR for my wife? And which form should be used?
2) Would the £18600 rule be applied in our case?
3) Does she need to take Life in the UK and B1 test?
4) What is the safest way to get ILR?

She currently has Discretionary Leave to Remain till next year June. Please kindly help me in this situation. Thank you very much.

How long has she been on DLR?

She got DL in May 2011.

She will qualify for ILR in May 2017, after 6 year of DL, or sooner depending on the circumstance, whether or not she will qualify under the Long residence provision or not.

I also have that option in my mind and long residence option as well. But is she eligible for ILR before it and would I need to prove my income £18600?

I can't see your wife qualifying for ILR before May 2016 or May 2017.

Were you on the Old Work permit at any period before securing ILR?

As rules stand, if you wife apply for ILR under DLR in 2016, then no need for B1 or LIUK test.

Under long residency she will need both.
