Hi all, i applied for a visa under the directive 2004/38/EU for my husband in egypt to join me in Ireland.Our application has been refused(after 2 months of waiting) based on the following: -You have not provided documentary evidence to show u are exercising your treaty rights and you have not submitted a copy of flight tiket. Im now very confused why they refused the visa as i submitted all the documents tht they requested including letters from work.im asking for any advise on this whether i should lidge an appleal or apply for a visa under national country law. Thanx

You're not Irish are you? You wouldn't be exercising your rights if you remained in your home country. 2 months is a terribly long time to wait for a decision. What sort of visa did you apply for? On the inis website it says for eu cizitens to initially apply for short stay c visa and it will be fast tracked. I think there's a maximum time but can't remember if it's 2 or 4 weeks.

I think you should tell the board the type of documents you submitted. When I applied for my chinese wife to come the instructions were to be able to prove that: there's an EU citizen (copy of passport), that there is a valid relationship (translated and legalized marriage cert), and that there's evidence that I was residing in Ireland (original utility bill, pps letter letter from landlord). It took them 6 days to reach a decision.

Hi and thank you for replay , im not irish national Im romanian citizen but i do live and work in the country from 4 years by now . I did submitted our marriage cert translated in english copy of our passports letter from my employer stating that im working under an permanent contract , invitation letter for my husband nd utility bill.The second reason i got refused was that i didnt submitted flight tiket. As i understood on the inis site that shouldnt book any tiket befor visa will b issued . So im getting confused wat else should i submit to proof that i do exercise my treaty rights here. We aplied for join supose visa tipe C

I would suggest to appeal the decision and attach your last 4 years P60's and P21's along with your last 3 months payslips and job letter. A new tax credit certificate from the tax office would be a great help as well. You can call the tax office and they will send it to you within few days. You can also download it from your online PAYE account if you have online access.

Also try to get a flight itinerary from the travel agent (Just a flight plan - Not an actual ticket).

Write a nice cover letter and appeal the decision within the given time.

The visa officer is on fault and just looking for an excuse to refuse the visa - I am 100% sure your husband's visa would be approved with the appeal process.
