PLEASE help with EE2 application

Post by FARHAN TAHIR » Tue Nov 04, 2014 9:40 pm

hello friends,
i am farhan in a relationship with Latvian national for last 3 years but have proof of adresses for 18 month.i went for marriage in registrar office but UKBA came there and stop my marriage and put me in detention centre for 6 days, i got temporary admission and again booked marriage at same registrar office and this time police stop marriage and put me in prison for 7 hours after release me without any documents.
i had pending application before i booked my first marriage at local registrar office and when UKBA came they came with my refusal letter of FLR(O)application which i made before booked marriage.Home office didnt post me that refusal letter.
i got bail from detntion centre becasue my solicitor requeted for reconsidration of their descion on my FLR(O)application.
i had hearing date in aug 2013. it heard by honourable judge for 90 minutes my partner was with me and her mother also in court at the time of hearing. Hearing was very good but got dismissed becasue judge said i had no right of appeal.
that was judge mistake and i apply for permission in upper tribunal and permission granted and got hearing date at upper tribunal after 4 month date.
again me and my partner were in court for hearing and that hearing was for one minutes only judge said they ll revert that descion to first tribunal becasue that mistake was done by first tribunal and they will hear again with some other judge.
in all above process i had spend so much on solicitors.
i was waiting for hearing date again from first tier tribunal and in mean time one evening ukba officers visit my house and interview us and they said they came to see that we are living togather or not and that visit was good for us and ukba officer advice me i should leave flr(o) and apply for visa application becasue i had marry with my partner in mosque relegious marriage.
so, on that basis i applied for ee2 visa application and got rejected again beacause they dont accept relegious marriages and 2nd our relationship was less then two years i mean on documents otherwise its more then 3 years now.
so now i made an appeal against their descion and one appeal was against flr(o).
and i have both hearing on one date 3rd dec 2014.
before hearings were on differnt dates but now i requested my solisitor make it possbile on one day and then i dont need to pay two time to solicitors and berrisors becasue i dont have to spend.
if any immigration expert will read this please help me with this that what i have to do now to win one of these two appeals.
which will b heard on 3rd dec, my solisitor is trying his best but if here is some kind person from immigration metter expert on ee2 please reply thnks

I am not an expert and cant advise you on your situation but I have been through the same situation (yours is even worst) ,I know one thing for sure that if your relationship is genuine no one can deport you and by the end of the day you will get your RC.May Allah ease your problems..

I am actually at a loss why your solicitor put in two sets of applications.

flr(O) does not apply to your case at all.

Putting FLR(O) appears to be a move to get extra cash from you.

Just a residence Card on the basis of Durable relationship would have been sufficient.

A durable relationship does not have to have lasted for a period of 2 years or more.

The Tribunal has ruled in many cases, that a blanket 2 years rule is unlawful.
