Converting from Tier 2 (G) main applicant to dependent in UK

Hi,
Currently i am holding tier 2 General visa with ABC company. But my wife was a dependent on me. But my wife got a JOB in XYZ company and they are ready to sponsor Tier 2 (G) visa.

So i would like to become Tier 2 (G) dependent from XYZ company.

Question :-

Is it possible to switch Tier 2 (G) Dependent to Tier 2 (G) Main applicant with in UK ?

Once she get her Tier 2 visa and come back to UK on the new Tier 2 visa, you can switch to her dependent within UK itself.

But currently she was in UK. So is it possible to switch with in UK ?

No. Tier 2 dependent cannot switch to Tier 2 within UK. She has to apply for an entry clearance from her home country. She will need a restricted CoS from her sponsor and they will need to conduct an RLMT before they can assign CoS to her.

If you read clearly, the below case addresses the issue of switching visa from "Main" to "Dependent" and not vice-versa (as in your case mentioned below). Due to this ruling, you are now able to switch from main to dependent within UK (and you need not go back to your home country) as mentioned in my previous post. The Tier 2 guidance states that you cannot switch from Tier 2 dependent to Tier 2 Main applicant and need to apply for a entry clearance from your home country.

I may not be able to add more info on the case mentioned. Maybe some of the seniors can throw some light if you still have any queries on it.

Be aware that your 5 year ILR clock will be reset (for both of you), unless you intend on eventually applying under long residence..
