URGENT - T2(General), SOC code on the CoS

Hello,

I am working in the UK under T2 General Visa at the moment. Now I was offered a new job from a different company, they have issued me restricted Certificate of Sponsorship (CoS). I finished my paper application form and ready for my appointment next Tuesday Morning 11th Nov 2014.

However, I wasn't sure if this time my job code on the CoS for T2(General) needs to meet NQF 6 level, as the one they issued for me is on Level 3 at the moment.

Is this going to be a problem? Will my application be refused? Should I ask my new employer re-issue the CoS with the right SOC code??

If I need to wait for re-issue of the CoS, should I change my appointment time now?

If you are applying from within the UK you need an unrestricted (not a restricted) CoS.
Your sponsor is responsible for determining the most appropriate SOC code.
NQF level 3 is acceptable if your initial T2G visa was under the rules before 6 April 2011.

Hi manci, thank you for your reply.

I am applying from the UK. Still at my current job and not yet resigned.

My current T2G visa was applied in Jan 2013 and it's valid from March 2013 to Feb 2016. The job was at NQF level 6 at the time when I applied.

The new sponsor has issued me a CoS with the job at NQF level 3 (after advertised the job for a month), is this NQF level 3 going to be a problem? I will be doing the same kind of work but a higher position, do I still need to meet the NQF level 6 in this case when I'm changing sponsor?

I don't know if I should ask my new sponsor to issue me a new CoS, and I have a appointment coming up on Tuesday morning, should I change to a later date?

How is it that if the jobs are the same the SOC codes and therefore the skill levels are different? What are the SOC codes for your present job and the new job?
If the new CoS is for an NQF level 3 job, and unless you are a high earner, your application will be refused. Have they given you a printout of the new CoS?

My current visa is my first T2G visa. Job code currently on is 2132 which doesn't exist anymore.

I wasn't sure why the new employer issued me the CoS with job code 3421 (Level 3), but I think my job is a mix between the two. I am not a high earner, have a print out of this CoS, and just told new employer on Friday they have to issue me a new one with correct job code 2136.

I've also moved my appointment to a later date. Are there anything else I can do now? How long it takes for a new CoS to be issued?

if they have an allocation available around 15 minutes, otherwise they should apply for an allocation increase through the SMS which should come through within 2 weeks or so depending on UKVI workload.

Thank you manci, I've changed my appointment to a month later so that should be enough for me to wait for a new one.

Btw, do you also know in my situation, what's the answer should be for "L10. Are you still working for the same employer as you were at the time of your last grant of leave?" ?? I am still at my current job so I should be answer 'YES', is it correct?

Also, if I paid everything online when the appointment booked, can I just leave the payment section empty on the paper form?

Hi manci, my employer has just come back to me says I should still go to the interview(which I have changed to a month later) and submit my form.
They said if it gets rejected (which he doesn’t feel it will as the categories have changed), then we can amend the categorisation quite easily.

What do you think? And what I should do?

if they won't assign an unrestricted CoS to you for an NQF level 6 job (with appropriate salary) forget about them and either stay in your current job or look for another sponsor.

if you have current leave the refusal will have no effect on it
