Overstayed UK Settlment Visa

Hi

I am a British Citizen My wife has overstayed her settlement visa for 4 months - my wife got pregant month before her expiry she is from pakistan and was ill due to her preganany and was addmitted to hospital as well in june i have filled in FLR form and included doctor notes hospital notes stating she is pregannt and was ill in them months we also have a 16 month old child who was born in the UK last Year she is due to give birth in November i have also included a covering letter stating the situation i have sent letter and documents and marriage certificates requested in the form what are the chances of her being granted FLR and if it is refusedare their any grounds we can appeal on(human rights ?)

The Home Office might be a bit sceptical about why being in hospital prevented your wife being extending her visa. What prevented her from physically filling in the FLR form before her current visa expired? You could have filled in the form for her and all she would have had to do was sign it.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

I think with an overstay of only 4 months, plus supporting evidence, your chances are good.

Appeals on Human Rights grounds almost always fail these days.

I have sent the documents last fri 31st today i can see the payment has been taken from my debit card how long will it take to get a replay and also i have further evidence to submit iv been told to send it to the croydon address will they already have my file as i only sent the file to durham on friday?

You should have a decision within three or four weeks.

Send everything to the Croydon address, send it recorded delivery, and mark it clearly with your reference number if you have one. And keep a copy of everything you send.

I have today recieved within a week of sending off the application a letter from the HO stating the need more correspondce for my wife and be from may 2005 till may 2006 does this mean they have overlooked the ''overstay'' and now are concerned with the correspondance that was sent to my wife and me on the above dates?

Regarding the documents my wife did not recieve much letters in her first year of stay she only recieved her antenatal appointments and letter which we have not kept the hospital and doctor has said tehy will provide us copies of letters we have sent out to you in that year will that be enough as the letter does state it wants orignals only - .

My MP also wrote to the Ho regading this matter she has sent me copy of the letter to me as well should i send that copy with the documents?

'' To help me consider the matter - please send me the follwing documentation . Please send ORIGINAL documentation as photocopies are NOT acceptable for the purpose of deciding your application.

Documents Required:

1. Further Documentary evidence from July 2005 to November 2006 for your self and from july 2005 to jan 07 for you spouse see guidence notes for types of doc.''
