Can sum1 help me please?

I applied my eea4 pr on 16th of October home office took money out from my account few days later I did not receive any acknowledgement or any confirmation yet.
I called HO today to find out that y it's talking too long lady who I spoke to told me that we are checking your driving offence that's y it's taking too long.last year I had problem with dvla I had 2 cars so I was using 1 and another one was parked on my drive way I ran out road tax on this car and I didn't renew it because I thought I am not going to use this car few weeks later my car was clamped by dvla short storry I paid all the fines and case was closed in my eea4 application form I did not mention that coz I thought that's not a trafic or criminal offence.
After I spoke to this lady am getting so worried that they might refuse my application based on this.
Can sum experts tell me if they can refuse my application or if they do what will happen next please?

I don't think that your office is serious enough to warrant a refusal under 15(3).

Thanks but only problem I have that I did not mention on my eea4 application form.

It is worth noting that Regulation 15 (3) does not only cover public policy, but also 21 (B)(2).

It appears that Home Office are systematically abusing that provision.

I have seen a case, where they are invoking that provision for criminal offence that was not declared.

It was wrongly alleged that the person was seeking to acquire right by fraud, in failing to declare a conviction.

It is clearly not the intention of the law, but it has not stopped them using it for that purpose.

Do u think that they can refuse my case based on that?if they do what other option do I have to solve that please?

You will have the option of lodging an appeal.

I don't think it will be a justified refusal if they refused on that basis, i was merely stating that i have seen then issuing refusals on that basis.

It has been 6 weeks I have not received any confirmation from home office only thing they are saying that they are checking road traffic offence.is that normal in any case?coz am getting stressed about this.

You need to write a letter setting out the law to them and the fact that you are entitled to a COA, irrespective of the number of checks they are doing.

I received my application confirmation yesterday but no COA yet.does any one know that how long will it take to get COA please and also to get decision on EEA4 please?

Hi experts

Am married to eea national since 2009 and lived in her country for 2 years than moved to Norway lived there for 1 year me and my wife both worked their got 5 years residence card from there after 1 year we moved to UK since August 2012 and since than have been living in uk we applied for eea family residence card which was issued in September 2013 my wife has been working and excercising her treaty rights since than.unfortunatly thing are not going well so we are in process to get divorce which she already applied in her country my eea family residence card is expiring in 2018 question is what option do I have now once the divorce is done can I live and apply further leave to remain in the uk.my wife had been her treaty rights from last 3 years and 4 months in 2 different eu countries first in Norway and now in the uk and I have got all the proofs.please can some1 help me on this?am really worried and concern on this.

Why Did you apply for EEA 4 in 2014 if you entered the UK in August 2012.

You EEA 4 will get refused, as you have not been residing in the UK for a period of 5 Years as an EEA Family Member.

You will have to Sort the Divorce out and then apply for Retention of Residence.


Now i see why the UKBA has been experiencing problem with your application.
